Indiana landlord-tenant basics, plus Fort Wayne's housing code

Indiana is generally considered landlord-friendly. Most of the rules are in Indiana Code Title 32, Article 31. The points investors ask about most:

  • Security deposit: within 45 days after the tenancy ends and the tenant gives you a mailing address, return the deposit or send an itemized list of deductions with the balance (IC 32-31-3-12). Missing the deadline can cost you the right to keep any of it, plus the tenant's attorney fees.
  • Nonpayment: give at least 10 days' written notice. If the tenant pays in full within the notice period, the tenancy continues (IC 32-31-1-6).
  • No local rent control: state law bars cities and counties from regulating rents and many other landlord-tenant terms (IC 32-31-1-20).
  • Fort Wayne: the city's Neighborhood Code Compliance office runs a housing registration and enforces the residential housing standards code (Chapter 152). Tenants can ask it to inspect after a landlord fails to make repairs, and violations bring a notice to the owner. Ask the office whether your property needs to be registered before you rent it.
  • Outside city limits, Allen County's building department handles minimum housing inspections. Auburn, Columbia City and other nearby towns have their own codes.

Short-term rental rules in Fort Wayne

We couldn't confirm a Fort Wayne short-term rental permit or license as of October 2026. State law sets the outer limits:

  • Indiana Code 36-1-24 treats renting out an owner-occupied home short term as a permitted residential use, and lets cities regulate STRs only for listed purposes such as health and safety, noise and nuisance. Check zoning for the specific parcel with the Allen County Department of Planning Services, which administers the Fort Wayne zoning ordinance.
  • Stays under 30 days owe Indiana sales tax plus the county innkeeper's tax. Platforms collect on many bookings; direct bookings are on you.
  • HOA covenants can still restrict rentals. Read them before you're under contract.
