Wilmington sits at the southern end of the Philadelphia metro, and the Census, BLS and Zillow figures here cover that whole metro, not Delaware alone. Typical home values in the Philadelphia-Camden-Wilmington metro are about $386,000 and typical rent about $1,900, or about 0.49% a month. A median-priced rental won't cash flow with a normal loan at that ratio, so investors here look for discounted, bank-owned and value-add deals. The metro's jobs are about 5% above 2019, but more Americans move out of it than in each year. Delaware caps deposits at one month's rent for leases of a year or more, Wilmington licenses and inspects every rental, and the state now taxes short-term rentals. Delaware landlord-tenant basics
Delaware's rules are in the Residential Landlord-Tenant Code, Title 25 of the Delaware Code, and Wilmington adds a city rental license. The points investors ask about most:
- Security deposit: capped at one month's rent when the lease is for a year or more. Furnished units are exempt from the cap (25 Del. C. § 5514).
- Deposit return: within 20 days after the lease ends, return the deposit or send a list of damages with the balance. Miss it and the tenant can recover double the amount wrongfully withheld, as long as they gave you a forwarding address.
- Nonpayment: a rent demand notice must give the tenant at least 7 days to pay before you file for summary possession. A 2025 law (SB 116) raised this from 5 days and gave tenants a right of redemption in nonpayment cases.
- Wilmington rental license: every rental property in the city must be registered with the Department of Licenses and Inspections, hold an annual residential rental license, and pass interior and exterior inspections on a two- or five-year cycle depending on unit count. Operating without them can bring a fine of up to $1,000.
- Out-of-area owners: if you live outside New Castle County, Wilmington requires a licensed property manager with both a city and a state business license, plus a signed management agreement.
Short-term rental rules in Delaware
Delaware taxes short-term rentals statewide. Local rules vary: we didn't find a Wilmington ordinance specific to short-term rentals, and the beach towns in Sussex County set their own rules.
- State tax: a 4.5% short-term rental lodging tax applies to rental agreements made on or after January 1, 2025. Cleaning fees, linen fees and security deposits aren't taxed.
- Who collects: if a platform like Airbnb or Vrbo books the stay, the platform collects and remits the tax. If you take direct bookings, you need a Delaware accommodations intermediary license and must file monthly.
- Local taxes: a municipality's own lodging tax is separate and paid to that municipality. New Castle and Sussex counties may add up to 3% in unincorporated areas.
- In Wilmington, any rental property falls under the city's rental license and inspection program. Confirm zoning and licensing for a specific address with the Department of Licenses and Inspections. Condo and HOA rules can also prohibit STRs.

Questions investors ask about Wilmington
Which areas does your Wilmington agent cover?
+−
Our vetted agent partner covers New Castle County, including Wilmington, plus Kent County and parts of Sussex County. He has worked REO and investor deals since 2002, has flipped homes, and owns rentals. Tell us your strategy, budget and target area and we'll match you.
Does Wilmington cash flow?
+−
Not at median prices. Rent-to-price across the Philadelphia-Camden-Wilmington metro is about 0.49% a month. Investors who make it work buy below median, through bank-owned or estate sales, or add value with a renovation. Your agent can pull Wilmington-specific rent comps.
Can I run an Airbnb in Wilmington?
+−
Delaware charges a 4.5% short-term rental lodging tax, which platforms like Airbnb collect for you. Every rental in Wilmington needs a city rental license and inspections, so check zoning and licensing for the address with the city first. Check HOA rules too.
Is Delaware landlord-friendly?
+−
It's in the middle. Deposits are capped at one month's rent on leases of a year or more and must be returned within 20 days. Since 2025, a nonpayment notice gives tenants 7 days to pay. Wilmington adds an annual rental license and inspections.
Can I invest in Wilmington if I live out of state?
+−
Yes, but if you live outside New Castle County, Wilmington requires you to use a licensed property manager for city rentals. Pick an agent who walks properties for you and attends inspections.
What does it cost to get matched with a Wilmington agent?
+−
Nothing. Agents Invest is free for investors. The agent pays us a referral fee only if you close a deal with them.
