Marietta is the Cobb County seat, about 20 miles northwest of downtown Atlanta, and most investors here are buying suburban single-family rentals in Marietta, East Cobb, Smyrna and Kennesaw. Zillow and the Census don't publish Marietta on its own, so the numbers on this page are for the whole Atlanta metro: typical home values about $377,000, typical rent about $1,850, roughly 0.49% a month. That doesn't cash flow at median prices, and values have slipped about 5% from their 2024 peak. Georgia is landlord-friendly, with no rent control, though the 2024 Safe at Home Act added a habitability duty, a deposit cap and a 3-business-day notice before eviction filings. Georgia landlord-tenant basics
Georgia's landlord-tenant law is in O.C.G.A. Title 44, Chapter 7. It's still landlord-friendly, but the Safe at Home Act (HB 404, signed in 2024) changed several rules for leases entered into or renewed on or after July 1, 2024:
- Habitability: every residential lease is now deemed to include a promise that the home is fit for human habitation, and the landlord must keep it in repair.
- Security deposit: capped at two months' rent. Return it within one month after the lease ends (or the tenant surrenders the unit), with a written list of any deductions. Landlords with more than 10 units (counting a spouse's and children's) or who use a management agent must also hold deposits in an escrow account and do move-in and move-out inspections, and can owe three times any amount wrongly withheld.
- Nonpayment: give the tenant written notice and at least 3 business days to pay before you file a dispossessory in Cobb County Magistrate Court. Once served, the tenant has 7 days to answer, and either side has 7 days to appeal a judgment. Lockouts and other self-help evictions are illegal.
- Cooling counts as a utility under the 2024 law: you can't shut off air conditioning before an eviction is complete.
- No rent control: O.C.G.A. 44-7-19 bars cities and counties from regulating rents. Repeal bills are filed most sessions (HB 299 in 2025–26), but none had passed at our last review.
Short-term rental rules in Marietta and Cobb County
Which rules apply depends on whether the property is inside Marietta city limits or in unincorporated Cobb County, and many "Marietta" mailing addresses are in the county:
- City of Marietta: the council has discussed regulating short-term rentals after neighbor complaints about parking and noise, including a license or registry and a required local contact. We couldn't confirm an adopted city STR permit as of our review, so check with the city before you buy.
- Unincorporated Cobb County: you need a county short-term rental certificate for each property from the Business License Division, renewed every year. The application asks for a 24-hour local contact and proof that you notified adjoining owners and any HOA. Renting without one is a $500 violation, and each night counts separately.
- Taxes: Georgia charges a $5 per night state hotel-motel fee, and state and local sales tax and local hotel-motel taxes also apply to stays of 30 days or less. Airbnb and similar platforms generally collect and remit the state fee for you.
- Neighboring cities set their own rules (Kennesaw adopted an STR ordinance in 2025), and HOAs can ban STRs regardless of what the city or county allows.

Questions investors ask about Marietta
Which areas do your Marietta agents cover?
+−
Our three vetted partners cover Marietta and the rest of Cobb County, including East Cobb, Smyrna, Kennesaw, Austell and Mableton, plus Roswell and Sandy Springs. Tell us your strategy, budget and target area and we'll match you.
Is Marietta a good market for cash-flowing rentals?
+−
Not at median prices. Across the Atlanta metro, typical rent is about 0.49% of the typical home value a month, and there's no Marietta-only series to say it does better. Rentals here make more sense as long-term holds in good school zones, or as below-median, value-add purchases.
Can I run an Airbnb in Marietta?
+−
It depends on where the property is. In unincorporated Cobb you need an annual county short-term rental certificate. The City of Marietta has discussed regulating STRs, and we couldn't confirm an adopted city permit as of our review, so check with the city first. HOAs can ban STRs either way.
Is Georgia landlord-friendly?
+−
Mostly. There's no rent control, and evictions go through a fast magistrate-court dispossessory. Since July 2024, though, every lease includes a habitability promise, deposits are capped at two months' rent, and you must give 3 business days' written notice before filing for nonpayment.
Can I invest in Marietta if I live out of state?
+−
Yes. Cobb's suburban single-family stock is relatively easy to manage remotely. Pick an agent who walks properties for you, attends inspections and connects you with a property manager.
What does it cost to get matched with a Marietta agent?
+−
Nothing. Agents Invest is free for investors. The agent pays us a referral fee only if you close a deal with them.
